10. LIMITATION OF LIABILIY

The domain-name holder agrees that the National Academy of Sciences shall not be liable of any loss or damage against the domain holder by reason of:

  1. The domain-name registration application process by the National Academy of Sciences.

  2. Any reasonable amendment of the domain-name registration during the registration period by the National Academy of Sciences.

  3. The denial of a domain-name registration application by the National Academy of Sciences except for any refund that shall be made to the petitioner of the domain name.

  4. Non-payment of the registration or renewal fee

  5. The implementation of the Dispute Policy in effect.

The holder of a domain name exempts the National Academy of Sciences, all liability for any loss of earnings (profits), loss of business or loss of anticipated savings, in which the holder of a domain name may incur.

The domain-name holder agrees that the National Academy of Sciences shall not be liable of any loss of registration or any other loss of the domain-name use or any business interruption or any other loss whether indirect, special, incidental or consequential, or any other loss (including loss of profits) whether under agreement, damages (including negligence) or any other.

Notwithstanding the foregoing, the domain-name holder agrees that any liability of the National Academy of Sciences with the domain-name holder shall not exceed the registration or renewal fee paid by the domain-name holder for the current registration period.

The domain-name holder agrees that it is technically impossible to provide a flawless service and, consequently, the National Academy of Sciences shall not undertake the service in regard thereto.

The domain-name holder shall hold harmless the National Academy of Sciences or its NIC InternetCosta Rica unit, or any of its directors, board of directors, officials, collaborators, intellectual property issues such as trademark infringement, breach of contract, unfair competition, libel, and damage or the like. Such liability shall continue in effect upon the termination, conclusion, or breach of the Registration Agreement which includes all the provisions set forth in the Policies for the Operation of the ".cr" Top-Level Domain in effect.employees of any claim by any third parties regarding a domain name or any kind of use and implementation by NIC Internet Costa Rica or any decision made and applicable in accordance with the Dispute Policy in effect. Such claims shall include, without limitation, those concerning any.

The National Academy of Sciences and its NIC Internet Costa Rica unit shall not assume any liability for the registration and the use of a domain name or any information usually included in the data records, and, particularly, for any trademark dispute, whether registered or unregistered, or any other intellectual or industrial property rights.
