5.1 Those that are authorized to request or perform removal: The Domain Holder and his Administrative Contact and NIC-Internet Costa Rica, will be the only ones authorized to request the removal of a Domain Name or perform its removal respectively. Thus amended by the publication in La Gaceta No. 237 of December 7th, 2009. 5.3 Removal Process: Jurisdiction Zone Assigned by Appointment: Due to the fact, that the National Academy of Sciences in the only entity that is authorized by the Internet Assigned Numbers Authority (IANA), for the Domain Name registration and administration in the ccTLD .cr, the jurisdiction zone assigned by appointment to a Domain Name applicant, whether individual or corporation, when the Domain Name registration has been completed under the TLD CR cannot be ceded, sole, donated, or assigned to another person, whether individual or corporation, different to the Domain Name Holder. It shall not be allowed that the Domain Name Holder of a domain under .CR will provide services of appointed jurisdiction of authority, whether total or partial, that was assigned upon the Domain Name registration. If the Domain Holder shall violate any of these regulations, NIC-Internet Costa Rica shall proceed to remove the Domain Name without any responsibility against National Academy of Sciences. Thus amended by the publication in La Gaceta No. 237 of December 7th, 2009. For any of the above situations, please present the original paperwork at NIC-Internet Costa Rica office. Once the paperwork specified in clause c) has been received at NIC-Internet Costa Rica, and the online Request from the Administrative Contact, the removal of a Third Level Domain Name will be applied at a maximum of 24-working hours. An online automatic notice will be sent to the Contacts of that domain informing them that the Removal has been approved. The 24-working-hour period is the valid period except in case of force majeure events, which are out of control of the National Academy of Sciences and its office, NIC-Internet Costa Rica. For Second Level Domain Name changes in the Primary DNS database and server, accordingly, the maximum time to apply these changes would be a 24-calendar-hour period. For lack of payment: In the event that that we do not receive the duly Renewal Fee for the domain, as established in Article 3, Policy, NIC-Internet Costa Rica shall proceed to remove the Domain Name. An online automatic notice will be sent to the Contacts of that domain informing them of the Removal. Due to Appeal from National or International Courts of Justice: At a given conflict of a Domain Name registered under .CR, NIC-Internet Costa Rica will proceed to remove the Domain Name whenever this is the verdict from National or International Courts of Justice. In case of the latter, the plaintiff must follow a proceeding of acknowledgement of international sentences in Costa Rica. NIC-Internet Costa Rica shall proceed with the removal of the Domain Name once we have received the written notice from the National or International Courts of Justice, with its duly acknowledgement in case of being necessary. For misleading, fake or unlawful use: In order to determine the existence of misleading or fake information provided during registration, or the unlawful, illicit or immoral use of the registered Domain Name in the Republic of Costa Rica, an administrative process will be carry out according to the current regulations. For erroneous Holder: In case that the registrant has entered a erroneous Holder and has registered a Domain Name for over a year period; and wants to register the same domain but under the correct holder; the Domain Name will be removed and will be available again for the registrant to request it, once NIC-Internet Costa Rica has been able to confirm the mistake made by the registrant and that there was absence of malice in the process upon registration. To investigate the mistake, NIC-Internet Costa Rica shall request pertinent information, and will be their decision if the rectification is possible or not, depending on the evidence offered. The registrant will be accountable for coordinating with NIC-Internet Costa Rica for the Domain Name removal for its later registration, since NIC-Internet Costa Rica will no be held responsible for other applications received with the same Domain Name through a third party. This proceeding will have the same cost as the One-year Domain Name registration fee, the surplus amount will be available for the user to carry out any other transaction, or be returned back to the user according to the internal proceeding from NIC-Internet Costa Rica on this type of situation. The money reimbursement or transferring to another transaction will only apply if the registration is less than one-natural year upon registration. Thus amended by the publication in La Gaceta No.30 of February 12th, 2008. 5.4 Exceptions During a controversy Contacts, Domain Holders or NIC-Costa Rica shall not be able to request a Domain Name removal in accordance with Article 8 of ".cr" Domain Name Conflict Resolution Policy and its Regulations, which are established on this document.
